A Moped Bill of Sale is a legal document that confers title and ownership of a moped (also known as a scooter) in exchange for a price agreed upon by both parties. As a written record of the transaction signed by the seller & the buyer, a bill of sale is used to prevent legal disputes over title & ownership, and aid in registration processes, tax filings, and future resales.

Use Case

A bill of sale is most commonly used in private, as-is sales transactions involving second-hand or used mopeds that are sold without a warranty.

Why Do I Need a Bill of Sale?

Even after the sale, if you ever need to prove title or ownership of your moped to a third party, such as a government tax agency or a potential buyer, you’ll need a Bill of Sale – so make sure to keep a copy for personal records!

If the moped is used for business or charter, a bill of sale helps you claim tax deductions, track depreciation, and prove the purchase for auditing purposes.

Moped Vs. Scooters: What’s the Difference, and Why Does It Matter?

Both mopeds and scooters are two-wheeled vehicles, but they differ in terms of engine size and speed, resulting in different registration requirements.

  • Mopeds usually have engines under 50cc and a top speed of 28–30 mph. For that reason, in many states, they do not require full registration or a motorcycle license, though some states, like Alabama or Rhode Island, treat them like motorcycles, and they must be registered as such.
  • Scooters come with engines ranging from 50cc to over 500cc, and can reach 70–80+ mph. Because of their power, most states require full registration and a motorcycle license for scooters, especially if they are used on highways.

Since laws vary by state, always check local DMV rules to determine whether registration and licensing rules apply to you.

What’s Included in a Moped Bill of Sale?

Even in states where a bill of sale isn’t mandated, there are specific requirements for what a bill of sale must contain if one is provided.

To be effective and legally enforceable, a Bill of Sale must contain the following:

  • Date & location of the sale
  • Buyer and Seller Info.
  • Payment Terms
  • A clear description of the moped, such as make, model, and year of manufacture, etc.
  • Tax Disclaimer
  • Legal Warranties
  • Pre-Sale Inspection Details
  • Supporting Docs
  • Signatures of buyer, seller, and witnesses (if any)

Without further ado, let’s walk you through each section of our template…

The Basics

Before delving into the specifics of the moped being sold or purchased, let’s cover some contract basics:

  • When was the bill signed? All terms stipulated in the agreement shall become effective as of this date.
  • Where was the bill of sale signed, filed, or notarized? Identifying the location ensures that the correct state or local laws are applied in case of a legal dispute later on.

Buyer/Seller Details

Identifying both parties to the sale is crucial for legal purposes and future reference. Use our dedicated space to record the following as accurately as possible:

  • Full legal name (first and surname)
  • Current postal address (residential or business)
  • Active Email ID
  • Verificed Telephone #

Terms of Payment

Enter the exact amount the buyer must pay to close the deal. Double-check that this section is fully completed and free of blank lines, which could later be misused to alter the price. You’ll need this record as proof of payment for tax filings.

Next up, specify your preferred mode of payment, such as cash, check, e-transfer, or a debit or credit card.

In case of non-monetary payments, for example, if a seller gifted or traded the moped to the buyer, you can use the alternate version of the template (Version II)

Moped Details

Clearly describing the moped in question makes it easier for both parties to stay on the same page and avoid any mix-ups about what’s being sold.

Here’s a quick breakdown of how to effectively describe a standard moped registered in the U.S:

  • Body Type:  Specify the body classification – typically “Moped” or “Scooter” for small-engine two-wheelers
  • Make: Enter the manufacturer’s name – e.g., Honda, Yamaha
  • Model: Indicate the exact model of the moped, say – the Ruckus NPS50
  • Year: Enter the year the moped was manufactured
  • Color: Write the primary color of the moped e.g. Matte Green
  • Odometer Reading: List the current mileage from the odometer1,235 miles
  • CCs: Enter the engine size in cubic centimeters (CC); under 50cc is typical for mopeds
  • VIN: A unique 17-digit number usually found on the frame or title
  • Engine No.: Usually stamped on the engine block
  • Registration No.: Enter the state-issued registration number, if the moped is registered

Blank space has been provided for any additional details or information NOT covered in our default categories. For example, you can highlight any distinguishing features or modifications, or clarify if any attachments or accessories are part of the sale.

Caution

Under U.S. law, sellers have to disclose if the odometer has exceeded its mechanical limits or been tampered with. In case of failure to do so, fraud laws may apply, leading to potential civil fines or criminal penalties, depending on where the transaction takes place.

Terms of the Sale: Warranties & Disclaimers

Clearly outline the seller’s liabilities after the sale using our template. It allows both parties to agree on fair terms upfront, minimizing the chance of future conflicts.

If you choose the first option, it means that the property is being sold as-is, that is, without any warranty or guarantee. In such a case, the seller is not obliged by law to repair or fix the moped after the sale or transfer.

If the seller does offer a warranty, check the second option and go on to indicate the active duration of the warranty (in years) in the space provided.

Tax disclaimer

Clarify if taxes are included in the purchase price. If they are, clearly state who will be responsible for paying them, the buyer or the seller. These may be municipal, state, or federal taxes—so be sure to correctly identify which ones apply to your transaction.

Keep in mind that if the moped is being transferred as a gift, different tax rules & regulations may apply.

Buyer’s Right to Inspect Before Purchase

Make sure to state whether the buyer is choosing to exercise or waive their right to inspect the ATV or snowmobile before the sale or transfer. Whenever possible, attaching a formal inspection report to the Bill of Sale is recommended—it serves as a valuable supporting document and helps protect both parties.

Final Steps: Signing and Verification

To make the bill of sale legally valid, both the buyer and the seller must sign and date the final document.

What happens next?

Once the agreement is signed, the original copy goes to the buyer. However, it’s important that both parties keep a signed copy for their own records. This serves as proof of the transaction and protects you in case of any future questions or legal issues.

Witness signatures (if required)

In some states, you may need to include witness signatures—ideally one witness for each party. This helps validate the agreement and may be required by law. Check your local regulations to see whether witnesses are necessary in your case.

Notarization (optional but advisable)

Though not always mandatory, notarizing the bill of sale adds an extra layer of legal protection. If your state requires it—or if you simply want extra peace of mind—sign the document in front of a Notary Public. This ensures that all signatures are authentic and made willingly, making the agreement more difficult to contest later.
