A Motorcycle Bill of Sale is a legal document that confers title and ownership of a motorcycle in exchange for a mutually agreed-upon price. As a written record of the transaction signed by both parties (seller/buyer), a bill of sale is mostly used to finalize the sale of used or second-hand motorcycles from a private owner who may or may not offer a warranty against it.

What We Offer

With a pre-standardized template tailored to the U.S. market, you don’t need to devote any extra time studying standard clauses or analysing elements of a sales agreement involving motorcycles. Grab our free template now to finalize the sale or transfer of all types of motorcycles. Covering all essential technical, regulatory, and financial aspects of a motorcycle sale, this template is ideal for first-time buyers or one-time sellers, who can use it to save hours in research, drafting, and formatting.

Why Do I Need One?

You need a properly completed Bill of Sale to:

  • Transfer the title and ownership of the motorcycle from the seller to the buyer
  • Document the purchase for legal, tax, and practical purposes
  • Record the terms of the sale for future reference
  • Safeguard both parties in case of disputes over ownership, condition, or payment
  • Comply with federal, state, and local regulations

In short, if you ever need to prove title or ownership of a motorcycle to a third party, such as a government tax agency or a potential buyer, you might be asked to furnish a Bill of Sale as legal proof of ownership – so always make sure you retain a copy of the bill after the sale!

How To Use & Customize a Premade Bill of Sale Like Ours!

Our template has been expertly crafted to meet your official documentation needs. Once you download the file to your computer, you’ll find 4 documents:

  • Motorcycle Bill of Sale
  • Odometer Disclosure Statement
  • Notary Acknowledgment Form
  • Checklist of supporting documents attached to any bill of sale involving the sale or legal transfer of any type of motorized or non-motorized vehicle registered or traded in the U.S.

Below, I discuss the key purpose and content of each document for your guidance. But first, let’s flesh out some basic details to ensure proper documentation:

  • When was the bill signed? All terms stipulated in the agreement shall become effective as of this date.
  • Where was the bill of sale signed, filed or notarized? Identifying the location ensures that the correct state or local laws are applied in case of a legal dispute later on.
  • Who is signing the bill? Identify both parties to the agreement (seller & buyer) by adding their full legal names and updated contact details (including email ID, physical address, and telephone number).

Step 1: Finalize Payment Terms & Method

Indicate the exact amount the buyer is required to pay to finalize the sale. This figure will be used to verify the purchase price during tax season. Be sure to complete this section carefully before signing, and leave no room for alterations to the selling price.

Next, specify your preferred method of payment, such as cash, check, or e-transfer.

If the payment is non-monetary—such as a gift or trade of the motorcycle—you may use this alternate version of the template.

note

Along with our standard categories, we have included blank space for you to include any additional details about the motorcycle that may be of potential interest or benefit to the buyer. Keep in mind, the more specific and detailed the description, the better.

Here are some pertinent points you might want to add here:

  • Details of previous owner(s)
  • Maintenance records
  • Modifications to the original design
  • Any cosmetic damage (scratches, dents, etc.)
  • Accident history
  • Special comfort or performance features
  • Details of any recent safety inspection or emissions test passed
  • Any requirements for future inspections or emissions testing
  • General condition of the bicycle, say, New, Excellent, Good, or Poor

Step 3: Navigating Laws & Regulations

Under the U.S. consumer protection laws, such as the Federal Trade Commission (FTC) rules, sellers are required to provide true & accurate information about the vehicle’s condition. Failure to do so could result in legal disputes or financial losses for them.

Use sections IV and V to confirm the following:

  • Whether the purchase price paid by the buyer is inclusive of government taxes
  • Whether the motorcycle is being sold as-is, that is, in its current condition, without any warranty or guarantee
  • The duration of the warranty

Pro Tip

If you are a seller, remember to disclose any known defects in the motorcycle to a prospective buyer. In case of failure to do so, fraud laws may apply.

Step 4: Provide a List of All Your Supporting Documents

Our template allows you to create a list of supporting documents to be attached to the Bill of Sale.

  • Title of the motorcycle
  • Proof of Insurance
  • Registration documents
  • Maintenance and service Records
  • Emissions or Inspection Certificates
  • Warranty documents (if applicable)
  • Copy of both the buyer’s and seller’s ID (driver’s licenses or passports)

Step 5: Sign, Date, and Notarize

To make it legally binding, both parties must sign and date the Bill of Sale. For additional verification, we provide space for witnesses to sign, affirming that the transaction involving a particular motorcycle took place on the specified date, location, and under the agreed terms.

Once signed, the buyer keeps the original Bill of Sale. However, both parties must retain a copy for their records as legal proof of the transaction, and a clear, written statement of the rights and responsibilities of each party to the sale.

Notarization (optional)

In some US states, the Bill of Sale must be signed in front of a Notary Public. Although notarization is not always required by law, it is highly recommended to add an extra level of verification, making the document harder to dispute in legal proceedings. This is especially important for high-value items or when required by certain states, legal jurisdictions, or government agencies.

What does an Odometer Disclosure Statement entail?

An Odometer Disclosure Statement is a formal document that records the mileage of a bicycle when it is sold or transferred. It’s signed by both parties, ensuring protection against odometer fraud and confirming adherence to state and federal regulations.

Our customizable, printable ODS form allows you to record the odometer reading, and for both parties (seller & buyer) to acknowledge & verify this statement by adding their signatures.

Good to Know

The buyer must disclose any issues with the odometer, such as tampering or exceeding its mechanical limits. Inaccurate or misleading disclosures can result in legal consequences, including civil fines or criminal charges, so be honest when completing this document.
