What is an Accident Report Form

This form can be used for internal reporting when you are not obliged by law to maintain such information. But it can also be used in place of the official OSHA 301 form (Injury and Illness Incident Report) if it complies with OSHA reporting requirements.

Recordkeeping Requirements OSHA

What are Work-Related Injuries or Illnesses?

OSHA defines work-related injuries as those “if an event or exposure in the work environment caused or contributed to the condition or significantly aggravated a preexisting condition. Work-relatedness is presumed for injuries and illnesses resulting from events or exposures occurring in the workplace…” 

There are some exceptions to this, though. For instance, if an employee is at the workplace as a general member of the public and not an employee. Suppose a bank employee visits his bank to encash a check on one of the days when he is not working. He faces a fall and is seriously hurt. However, he was not working that day and visited the bank as a member of the general public; although it was his place of work, it is not considered a work-related injury.

Other exemptions include:

  • Certain parking lot incidents
  • Non-work-induced mental illness
  • Colds or flu
  • Injuries that arise from personal meals or grooming
  • Injuries that are self-inflicted or self-medicated
  • Injuries that occur on work premises but are due to a natural disaster

I am a Small Business. Do I need to Maintain Records of any Incidents?

Not everyone needs to maintain incident reports at their workplace. There are certain exemptions for smaller industries (less than 10 employees), and then there are also certain industries that are partially exempt from recording requirements as well. Unless you are asked in writing to do so, you are exempt from recording incidents if your business falls in these categories.

What is the Difference between a Reportable and a Recordable Incident?

Reporting an incident at the workplace and recording it are not the same thing in the context of workplace safety regulations.

While every incident is recordable, it becomes a reportable one for OSHA if:

  1.  It causes a fatality, or 
  2. It causes injuries that require inpatient hospitalization or that result in amputation or loss of an eye.

Plus, there are also regulations surrounding the time frames for such reporting. If the injury was fatal, then it must be reported to OSHA within 8 hours of the incident. If an incident led to inpatient hospitalization, amputation or loss of an eye of an employee, then you must report it within 24 hours.
